Trademark Renewal Process (As per Section 25 of the Trademarks Act, 1999)

1. Filing the Renewal Application

• The trademark owner must apply for renewal before expiry using Form TM-R.
• The renewal period lasts 10 years, with a 6-month grace period for late renewal (with an additional fee).

2. Examination & Publication

• The Registrar reviews the application for compliance.
• If approved, the renewed trademark is published in the Trademark Journal for 4 months to allow objections.

3. Trademark Renewal Certificate

• If no objections arise, the Registrar grants the Trademark Renewal Certificate, extending protection for another 10 years.

Restoration of a Lapsed Trademark

If a trademark is not renewed within the grace period, it gets removed from the register. However, it can be restored within one year from expiry by paying an additional surcharge.

• Identity & address proof of the applicant
• Power of Attorney (if filed by an agent)
